Terms of Service

Welcome to PoolRoute Ops ("Service"), operated by PoolRoute Ops ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. These Terms apply to all users, including account owners, administrators, office staff, and field technicians.

2. Description of Service

PoolRoute Ops is a field service management platform for pool service businesses. The Service includes scheduling, dispatching, customer management, invoicing, payment processing, inventory tracking, reporting, and integrations with third-party providers such as QuickBooks Online and CardConnect.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Subscription and Billing

Access to the Service requires an active subscription. Subscription terms, pricing, and billing cycles are presented during signup and may be updated with notice. You authorize us to charge your payment method for applicable fees.

5. Payment Processing

The Service integrates with third-party payment processors (e.g., CardConnect) to facilitate payment collection from your customers. We do not store raw credit card numbers. Payment processing is subject to the terms and conditions of the respective payment processor. You are responsible for compliance with payment card industry (PCI) requirements applicable to your business.

6. Third-Party Integrations

The Service connects with third-party services such as QuickBooks Online, SendGrid, and Twilio. Your use of these integrations is subject to the respective third-party terms. We are not responsible for the availability, accuracy, or security of third-party services. When you connect a third-party account (e.g., QuickBooks), you authorize us to access and sync data on your behalf.

7. Data Ownership and License

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited license to use, store, and process Your Data solely to provide and improve the Service. We will not sell Your Data to third parties.

8. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) interfere with the Service's operation or security; (c) attempt to gain unauthorized access to other accounts or systems; (d) transmit malicious code; or (e) violate any applicable law or regulation.

9. Customer Portal

The Service includes a customer-facing portal that allows your customers to view invoices and manage payment methods. You are responsible for informing your customers about the portal and its terms of use. Portal access is authenticated via time-limited, single-use tokens sent by email.

10. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. Support is available via email at support@poolrouteops.com.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

Either party may terminate these Terms at any time. Upon termination, your access to the Service will cease. We will retain Your Data for a reasonable period to allow export, after which it may be deleted.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.
